Information concerning the personal data protection

Dear Sir/Dear Madam,

In view of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repeal of Directive 95/46/CE, in our capacity as an operator, we further provide the following details about when and why we process your personal data, the manner in which we use them, the conditions in which we can disclose them o others and the manner in which we safely store them. We process your personal data for specified purposes

In view of your capacity of legal representative, authorized agent or contact person, we process your personal data for the following purposes:

  • execution of the contract concluded with the legal entity on whose behalf you act;

  • Compliance with the rules, the legal regulation, the conduct codes or the applicable guides or for law enforcement and cooperation with the competent authorities (including, but not limited to, tax and legal authorities).

We process your personal data for the purpose of performing the contract (which also includes the interactions prior to its signature) with the legal entity on behalf of which you act and for the fulfillment of our legal obligations as a contracting party.

Moreover, we process your personal data in order to satisfy legitimate interests, such as:

  • The prevention, detection and investigation of criminal offences, including fraud and money laundering or financing of acts of terrorism, as well as the analysis and management of commercial risks;

  • In connection with any claim, action or procedure (including, but not limited to, the drafting and reviewing of documents, drawing up of documentation necessary to complete a transaction, obtaining legal advice and facilitation of the resolution of litigation and/or for the protection or exercise of our contractual and legal rights and obligations;

  • Cooperation with public authorities

  • Management and preparation of internal reports, feedback request or participation in surveys, as well as the carrying out of researches and/or analyses for statistical purposes, so as to establish our products, to understand the customers behavior, the market preferences and trends and to review, develop and improve the quality of our products.

 

Your personal data are disclosed to other third parties

To facilitate the conducting of activities relating to the purposes of the processing previously detailed, we communicate these data to third parties, including our partners, for example, to:

  • other contracting parties and their banks, in connection with any type of transfer of funds;

  • suppliers of operational services, such as courier, telecommunication, IT, payment, processing, training, storage, archiving services, investigation services pertaining to customer assistance;

  • any business partner, investor, assignee(current or potential) to facilitate the transactions with commercial assets(which can include a merger, an acquisition, a debt or sale of goods);

  • professional advisors, such as auditors or lawyers;

  • regulatory authorities, professional bodies and/or public authorities in order for us to comply with the applicable regulations.

We shall transfer your personal data outside the European Economic Area, in compliance with the legal provisions in force, by applying adequate protection measures.

Your rights concerning the personal data

Unless otherwise specified in the law, you have the following rights:

  • the right of access, respectively the right to obtain our confirmation that we process your personal data, as well as the access to these data and the provision of information about how these data are processed;

  • the right to rectification which refers to the correction without undue delay of inaccurate personal data and/or supplementing the incomplete data;

  • the right to erasure/the right to be forgotten, namely the right to erase without undue delay your personal data collected, if these data are no longer necessary for achieving the purpose for which they were collected and there is no other legal basis for processing , the data  have been illegally collected or the data must be erased in order to comply with a legal obligation;

  • the right to restriction of processing, which applies when (i) you contest the accuracy of the personal data, (ii) processing is illegal and you oppose to the erasure of your personal data, requesting the restriction of processing instead, (iii) we no longer need your personal data, but you require them for the establishment, exercise or defense of legal claims, (iv) you have opposed the processing for the period of time  during which it is verified if our legitimate interests in the processing of personal data prevails on your rights;

  • the right to oppose processing, except for the case when we prove that we have legitimate reasons to process your data, reasons which prevail over your interests, rights and freedoms or for the establishment, exercise or defense of legal claims;

  • the right of portability, respectively your right to receive the personal data, which you provided us for the purposes indicated in this document, in a structured format, currently used and which can be automatically read, as well as the right to send these data to another operator;

  • the right to lodge a complaint with the National Authority for the Supervision of Personal Data Protection (ANSPDCP);

  • the right not to be subject to a decision based solely on automated processing, including profiling , which produces legal effects on you or similarly significantly affects you, except for the case in which such processing is necessary for the execution of the individual employment agreement or it is permitted by law

Except for the right to lodge a complaint with ANSPDCP, as previously indicated, these rights can be exercised by sending a written request:

We do not perform an automated processing of your personal data

Period of retention

We shall keep your personal data for the period of time necessary for the compliance with the legal obligations specific to our field of activity or in accordance with the applicable limitation periods (for example, 5 years since the date of termination of the contractual relationship) or for compliance with the archiving obligations imposed by the applicable law (e.g. the law specific to financial and accounting matters).

Security of personal data

The company shall make all reasonable efforts to protect your personal data in our possessions or control by establishing reasonable security measures in order to prevent the unauthorized access, collection, use, disclosure, copying, modification or erasure, as well as any other similar risks.
